Qualcomm states Apple still “violating the injunctions” following iOS 12.1.2 update

Wednesday December 19, 2018. 12:15 PM , from Power Page
In spite of Apple’s release of iOS 12.1.2 on Monday, which was speculated to resolve grievances between Apple and Qualcomm, Qualcomm continues to be dissatisfied with Apple, stating that the company “continues to flout the legal system” and ignore injunctions imposed on it in China.
In the ongoing legal battle between Apple and Qualcomm, Qualcomm General Counsel Don Rosenberg said:
“Despite Apple’s efforts to downplay the significance of the order and its claims of various ways it will address the infringement, Apple apparently continues to flout the legal system by violating the injunctions.”

Mr. Rosenberg stated that Apple was wrong to believe that the injunction imposed in China on December 10th only applied to older iPhone models. Per the attorney, Apple seemed to believe that the injunction only applied to the iPhone 6S and Plus, iPhone 7 and Plus, iPhone 8 and Plus, and the iPhone X. It thought the iPhone XS and Plus were exempt as it released them later.
According to Qualcomm’s perspective on the issue, the judgement, and its following injunction, only mentioned software features, and not any specific operating system.
“Apple’s statements following the issuance of the preliminary injunction have been deliberate attempts to obfuscate and misdirect,” said Mr. Rosenberg.
Apple, in turn, has insisted that the company is in compliance with the Chinese court order, and has already appealed the decision, stating that it is not in violation of any patents.
Stay tuned for additional details as they become available.
